Privacy Policy
Effective Date: May 25, 2026
Last Updated: May 25, 2026
This Privacy Policy describes how Sea Whip Properties LLC ("we," "us," or "our"), operating vacation rental properties out of Florida, collects, uses, shares, and protects information about you ("you" or "guest") when you visit our website, submit an inquiry, make a booking, or otherwise interact with us.
We respect your privacy and are committed to handling your personal information responsibly and in compliance with applicable laws, including the Florida Digital Bill of Rights, the California Consumer Privacy Act (CCPA/CPRA), and the EU General Data Protection Regulation (GDPR), where applicable.
1. Information We Collect
We collect the following categories of personal information:
Information you provide directly: Your name, email address, phone number, mailing address, date of birth (where required), number of guests, travel dates, special requests, and any other details you submit through inquiry forms, booking forms, or messaging.
Payment information: Payment card details and billing information. We do not store full payment card numbers ourselves — payment data is collected and processed directly by our payment processor, Stripe (see Section 4).
Booking and guest information: Reservation details, guest preferences, communication history, reviews, and any documents you submit (e.g., signed rental agreements).
Automatically collected information: When you visit our website, we automatically collect technical information including IP address, browser type and version, device type, operating system, referring URL, pages viewed, time spent on pages, and other usage data. This is collected through cookies, pixels, and similar tracking technologies.
Information from third parties: When you book through a channel partner (e.g., Airbnb, Vrbo, Booking.com), we receive your contact and reservation information from that platform.
2. How We Use Your Information
We use your information to:
- Process inquiries, quotes, bookings, payments, and refunds
- Communicate with you about your reservation, including pre-arrival instructions, check-in details, and post-stay follow-up
- Send booking confirmations, receipts, and required legal notices
- Provide customer support and respond to your requests
- Comply with legal obligations, including tax reporting and lodging regulations
- Detect and prevent fraud, security incidents, and misuse
- Improve our website, services, and guest experience
- Send marketing communications (only where permitted; see Section 7 on your rights)
- Conduct targeted advertising via Google Ads and Meta (Facebook/Instagram) Ads
3. Cookies and Tracking Technologies
Our website uses cookies and similar technologies (including pixels and tags from Google and Meta) to recognize you, remember preferences, analyze site traffic, and serve relevant advertising. You can control cookies through your browser settings. Disabling cookies may limit some functionality of the site.
We use the following tracking and analytics services:
- Google Analytics / Google Ads (including the Google Ads conversion pixel and remarketing tags)
- Meta (Facebook) Pixel for advertising and conversion tracking
- reCAPTCHA (by Google) for spam and fraud prevention on forms
These services may collect information about your visit and combine it with information from other sites you visit. You can opt out of personalized advertising at google.com/settings/ads and facebook.com/ads/preferences.
4. How We Share Your Information
We do not sell your personal information. We share information only with the following categories of third parties, as needed to operate our business:
Service providers (data processors):
- OwnerRez — our property management, booking, and website platform (ownerrez.com/legal/privacy)
- Stripe — payment processing (stripe.com/privacy)
- PriceLabs — dynamic pricing and revenue management (pricelabs.co/privacy-policy)
- Google — advertising, analytics, and reCAPTCHA (policies.google.com/privacy)
- Meta Platforms — advertising via Facebook and Instagram (facebook.com/privacy/policy)
Booking channel partners: When you book through Airbnb, Vrbo, Booking.com, or similar platforms, that platform shares reservation information with us and we may share information back as required to fulfill the booking. Each platform has its own privacy policy that governs information you provide directly to them.
Legal and safety: We may share information if required by law, subpoena, or court order, or to protect the rights, property, or safety of our business, guests, or others (e.g., reporting damage, fraud, or illegal activity).
Business transfers: If we sell or transfer our business or assets, your information may be transferred as part of that transaction.
5. Data Retention
We retain your personal information for as long as needed to provide services and comply with legal, tax, accounting, and dispute-resolution obligations. Booking records are typically retained for at least seven (7) years to satisfy tax and recordkeeping requirements. You may request deletion at any time, subject to our legal obligations to retain certain records.
6. Data Security
We use reasonable administrative, technical, and physical safeguards to protect your information, and we work only with service providers that maintain industry-standard security practices (including PCI-DSS compliance for payment processing). However, no method of transmission or storage over the internet is 100% secure, and we cannot guarantee absolute security.
7. Your Privacy Rights
Depending on where you live, you may have the following rights regarding your personal information:
For all guests:
- Request access to the personal information we hold about you
- Request correction of inaccurate information
- Request deletion of your information (subject to legal retention requirements)
- Opt out of marketing emails by using the unsubscribe link in any message we send
For California residents (CCPA/CPRA): You have the right to know what personal information we collect, to request deletion, to correct inaccurate information, to opt out of any "sale" or "sharing" for cross-context behavioral advertising, and to be free from discrimination for exercising these rights. We do not sell personal information for money, but the use of advertising pixels (Google, Meta) may be considered "sharing" under CPRA — you may opt out by emailing us at the address below.
For EU/EEA/UK residents (GDPR/UK GDPR): You also have the rights to data portability, to restrict or object to processing, and to lodge a complaint with your local data protection authority. Our legal bases for processing are contract performance (your booking), legitimate interest (operating our business, fraud prevention), legal obligation (tax/lodging laws), and consent (marketing and non-essential cookies).
For Florida residents (Florida Digital Bill of Rights): While the FDBOR's main obligations apply to very large businesses, we voluntarily honor similar rights — access, correction, deletion, and opt-out — for all Florida guests.
To exercise any of these rights, email us at info@seawhipproperties.com. We will respond within 45 days (or 30 days for GDPR requests).
8. Children's Privacy
Our services are not directed to children under 16, and we do not knowingly collect personal information from children. If you believe a child has provided us with personal information, please contact us so we can delete it.
9. International Data Transfers
If you are located outside the United States, please note that information we collect will be processed in the U.S. By using our website or making a booking, you consent to this transfer. Where required, we rely on Standard Contractual Clauses or equivalent safeguards for transfers from the EU/UK.
10. Third-Party Links
Our website may contain links to third-party sites (including booking channels and social media). We are not responsible for the privacy practices of those sites. Please review their privacy policies before providing any information.
11. Changes to This Policy
We may update this Privacy Policy from time to time. The "Last Updated" date at the top will reflect any changes. Material changes will be communicated through a notice on our website. Continued use of our services after changes means you accept the updated policy.
